1. Agreement to Terms

By accessing or using PoolFlow ("Service"), operated by PoolFlow LLC ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

PoolFlow provides a booking and payment platform that connects pool service contractors ("Contractors") with their customers ("Customers"). The Service includes:

Online booking widgets for contractor websites
Payment processing through Stripe
Quote management and customer communication tools
Pool measurement and pricing tools

3. User Accounts

3.1 Contractor Accounts

Contractors must provide accurate business information, including valid contact details and business credentials. You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

3.2 Customer Accounts

Customers who book services through PoolFlow may create accounts to manage their bookings and payment methods. Customers are responsible for providing accurate contact and payment information.

4. Payments and Fees

4.1 Platform Fees

Contractors pay a monthly subscription fee based on their selected plan. All fees are non-refundable except as expressly set forth in these Terms or required by law.

4.2 Payment Processing

All payments are processed through Stripe. By using our Service, you agree to Stripe's Terms of Service and Privacy Policy. We are not responsible for any issues related to payment processing by Stripe.

4.3 Contractor Payments

Funds collected from customers are deposited directly into the Contractor's connected Stripe account, less any applicable processing fees. PoolFlow does not hold customer funds.

5. Service Relationship

PoolFlow is a technology platform that facilitates connections between Contractors and Customers. We are not a party to the service agreement between Contractors and Customers. The actual pool services are provided by independent Contractors, not by PoolFlow.

We do not guarantee the quality, safety, or legality of services provided by Contractors. Contractors are solely responsible for their services, pricing, and compliance with applicable laws.

6. Cancellations and Refunds

Cancellation and refund policies are set by individual Contractors. Customers should review the Contractor's policies before booking. PoolFlow may facilitate refunds at the Contractor's request but is not responsible for determining refund eligibility.

7. Prohibited Uses

You agree not to use the Service:

For any unlawful purpose or in violation of any laws
To harass, abuse, or harm another person
To impersonate any person or entity
To interfere with or disrupt the Service or servers
To attempt to gain unauthorized access to any part of the Service
To transmit viruses, malware, or other malicious code
To scrape or collect data from the Service without permission

8. Intellectual Property

The Service and its original content, features, and functionality are owned by PoolFlow LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without express written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

WE DO NOT WARRANT THE QUALITY, ACCURACY, OR RELIABILITY OF ANY SERVICES PROVIDED BY CONTRACTORS THROUGH THE PLATFORM.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POOLFLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless PoolFlow, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Maricopa County, Arizona.
